1. Who is responsible
Robosurf Service GmbH, Pestalozzistraße 25, 22305 Hamburg, Germany
Email: mail@robo.surf - Phone: +49.40.29996504
2. Visiting this website
This website is hosted by Netlify, Inc., San Francisco, USA. When you open a page, your browser sends technical data to Netlify's servers, for example your IP address, the date and time, the page requested, the referring page and your browser type. This is necessary to deliver the website and keep it secure. Legal basis: Art. 6(1)(f) GDPR (our legitimate interest in a working, secure website). Netlify keeps these log data for a limited period under its own terms. We do not use them to identify visitors.
Without your consent, this website sets no cookies, uses no analytics or tracking tools and loads no content from third parties. The only exception is Google Analytics, which runs only if you click "Accept" (section 3). Fonts and videos are served from our own server. Links to YouTube, LinkedIn, Instagram and WhatsApp are plain links. Data goes to those services only if you click a link, and from then on their own privacy policies apply.
3. Web analytics with Google Analytics (only with your consent)
If you click "Accept" in the cookie banner, we use Google Analytics 4 to see how our website is used: which pages are visited, how long for, where visitors come from (referring website, approximate location by country and city), which device and browser they use, and interactions such as scrolling, clicks on outbound links, file downloads and video plays. We use these figures only in aggregated form to improve the website. We do not use them to identify you, and we do not use Google Analytics for advertising.
Google Analytics stores two cookies in your browser: _ga (distinguishes visitors, up to 2 years) and _ga_<ID> (keeps the session, up to 2 years). Google Analytics does not store your IP address. Google uses it only to determine your approximate location and then discards it. Google Analytics keeps the data linked to these cookies for 2 months. After that only aggregated statistics remain.
Provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, as our processor under Art. 28 GDPR. Data may be transferred to Google LLC in the USA (see section 6).
Legal basis: your consent. For storing and reading the cookies in your browser, § 25(1) of the German Telecommunications Digital Services Data Protection Act (TDDDG). For processing the data, Art. 6(1)(a) GDPR. If you click "Reject" or do nothing, Google Analytics is not loaded and no data goes to Google.
We store your choice in your browser for 12 months so the banner does not appear on every page. This is necessary to respect your choice (§ 25(2) no. 2 TDDDG). You can change or withdraw your consent at any time with effect for the future via the "Cookie settings" link at the bottom of every page.
4. Contact form and email
If you use the contact form, we process the details you enter: name, email address, message, and optionally company and phone number. We use them only to answer your enquiry and, if a business contact results, to manage that contact. The form is processed by Netlify (Netlify Forms), which stores the submission and forwards it to our mailbox, mail@robo.surf. Our mailbox is hosted by Google (Google Workspace). We then keep your details in our customer relationship management (CRM) system Nimble, which CS Platforms Ltd operates for us (see section 6). The same applies if you email us directly. Legal basis: Art. 6(1)(b) GDPR if your enquiry relates to a contract or a possible contract, otherwise Art. 6(1)(f) GDPR (our legitimate interest in answering enquiries and managing business contacts).
Form submissions stored at Netlify are deleted automatically after 6 months. We delete your enquiry in our mailbox and in Nimble once it is no longer needed for these purposes, unless statutory retention periods under commercial or tax law require us to keep it, for example because it leads to a business relationship.
5. Newsletter
If you sign up for our newsletter, we process your email address and, if you provide it, your name, to send you news about Robosurf and robotics for construction and industry. Your sign-up reaches our mailbox mail@robo.surf via Netlify (Netlify Forms), and we keep it in our CRM system Nimble, which CS Platforms Ltd operates for us (see section 6). Before the first newsletter, we send you an email asking you to confirm your sign-up. You only receive the newsletter after you confirm. The newsletter is sent with Nimble through our Google Workspace mailbox.
Legal basis: your consent, Art. 6(1)(a) GDPR. You can withdraw it at any time with the unsubscribe link in every newsletter or by emailing mail@robo.surf. Withdrawal does not affect processing that took place before it. We keep your data until you unsubscribe. After that we keep only your email address and the record of your sign-up, confirmation and withdrawal, for as long as we need to prove that your consent was given. If you do not confirm your sign-up, or if we have not sent a first newsletter within 12 months of your sign-up, we delete it. Netlify deletes the form entry automatically after 6 months.
6. Service providers and transfers outside the EU
We use these processors, each bound by a data processing agreement under Art. 28 GDPR:
- Netlify, Inc. (USA) - website hosting and forms
- CS Platforms Ltd, London, United Kingdom - operates our CRM system for us. It uses the sub-processor Nimble, Inc. (USA) for contact management and for sending the newsletter
- Google (Google Workspace) - email
- Google Ireland Limited (Ireland) - web analytics (Google Analytics), only with your consent
For the United Kingdom, the European Commission has decided that the level of data protection is adequate (Art. 45 GDPR). Netlify, Nimble and Google LLC (also for Google Ireland's analytics service) are certified under the EU-U.S. Data Privacy Framework. The European Commission has decided that this certification ensures an adequate level of data protection (adequacy decision of 10 July 2023, Art. 45 GDPR). We do not sell your data or pass it to anyone else, unless we are legally required to.
7. Your rights
You have the right to access your data (Art. 15 GDPR), to rectification (Art. 16), to erasure (Art. 17), to restriction of processing (Art. 18) and to data portability (Art. 20). Where we rely on our legitimate interest, you have the right to object on grounds relating to your particular situation (Art. 21). You can withdraw consent at any time with effect for the future (Art. 7(3)). To exercise any of these rights, email mail@robo.surf.
8. Right to complain
You can complain to a data protection supervisory authority. The authority responsible for us is: Der Hamburgische Beauftragte für Datenschutz und Informationsfreiheit, Ludwig-Erhard-Str. 22, 7. OG, 20459 Hamburg, mailbox@datenschutz.hamburg.de.
9. Do you have to provide data?
No. You can use the website without entering any data and without consenting to Google Analytics. Without an email address, we cannot answer an enquiry or send the newsletter.
